Journal Article 2018 11 05 The primary basis of the Islamic Republic of Iran's system is the absolute Vilayat-e Faqih, one of the essential concepts in Shiite jurisprudence. Vali-e Faqih cannot solve modern problems and problems of contemporary society only with primary and secondary commands. Instead, using the element of expediency, governmental rule, the law of essential and more important, and the consideration of time and place, can solve emerging problems. The present study aimed to explain the impact of time and place on contraction and expansion of the empowerment of the Islamic ruler’s authority and propose new theoretical researching the use of absolute Vilayat-e Faqih for facilitating community affairs. To this aim, the role of time and place in ijtihad, commands, the emergence of new topics, discovering new investigating the effect of time and place on contraction and expansion of the authority of the Islamic Ruler. ولایت مطلقه فقیه از مهمترین مفاهیم در فقه شیعه به شمار می‌رود که پایه اصلی نظام جمهوری اسلامی ایران است و التزام به اجتهاد ولایت مطلقه فقیه در زمان و مکان حاضر امری منطقی است. لفظ ولایت از واژه‌هایی است که علاوه بر کاربرد لغوی در حوزه‌های دیگری همانند، فقه، عرفان، کلام و... به‌کار رفته است. موضوع ولایت فقیه از جمله مباحث فقهی است که به تفصیل بیان شده و در قرآن نیز خود لفظ و مشتقاتش 233 با تکرار شده است. پژوهش حاضر به دنبال پاسخگویی به این سؤال است که آیا ارتباطی بین ولایت مطلقه فقیه با نقش زمان و مکان در اجتهاد وجود دارد؟ این پژوهش به روش توصیفی، تحلیلی و با بهره‌گیری از منابع معتبر به بررسی چگونگی ارتباط ولایت مطلقه فقیه با نقش زمان و مکان در اجتهاد پرداخته است. نتیجه این پژوهش نشان می‌دهد دیدگاه فقهای شیعه در مورد ارتباط ولایت مطلقه فقیه با نقش زمان و مکان از نظر تعریف مسئله متفاوت است اما از نظر مفهوم دارای یک مصداق واحد است. https://jcrir.ut.ac.ir/article_76462_d8a791d3ce82e6a2cda374fe6f245c6d.pdf
