Prosperity, failure, dignity, and degradation of any society are directly affected by the power presiding over it. Therefore, universities and educational centers have long put the research, clarification, and the teaching of governing theories, principles, and sub-principles in their academic perspective. Both Shias and Sunnis accept guardianship and governance as a principle to a functioning society while disagreeing on the Islamic ruler's qualifying conditions. When theorizing the jurist's control (Wilaya of Faqih), Shia scholars solely assume their take on Islam for granted, almost irrespective of the Sunni perspective. Therefore, people may rightfully ask: ‘what are the Sunnis scholarly and jurisprudential stance on the Islamic jurist's guardianship?’ ‘Is this specific to the Shia world and limited to Shia Jurisprudential (Fiqh) theorizations or Sunnis supporting it?’ What are the privative and affirmative Sunni views for jurisprudence (Fiqaha) as a qualifying condition for the Islamic ruler?’ and ‘what are these views based?’ ‘What traits and requirements are necessary for the Islamic ruler from the Sunni scholarly perspective and whether or not it is possible to deduce the Islamic jurist's guardianship, as an exigent Islamic issue, from the Sunni-recognized Hadiths?’ These are questions to which this article will seek to provide answers from the viewpoint of political jurisprudence. ضرورت اصل ولایت و حکومت در میان شیعه و اهل سنت امری مسلم و پذیرفته شده است و آنچه در اندیشه سیاسی این دو مذهب، مورد اختلاف است شرایط و مصادیق حاکم اسلامی می باشد.<br />در محافل علمی ما عموماً به هنگام نظریه پردازی در خصوص ولایت فقیه ، برداشتهای شیعی از اسلام و دین، مفروض تلقی شده و دیدگاههای اهل سنت ، چندان مورد عنایت قرار نمی گیرد ؛ لذا این سؤال ممکن است مطرح باشد که موضع علمی و فقهی اهل سنت در خصوص ولایت فقیه چیست؟ آیا این مقوله مختص عالم تشیع و نظریه های فقهی شیعه است یا اینکه در میان اهل سنت نیز طرفدارانی دارد؟ و اینکه چه نظرات و دیدگاههایی در میان اهل سنت در خصوص ضرورت فقیه بودن حاکم اسلامی به صورت ایجابی یا سلبی مطرح است؟ و این دیدگاهها برچه مبانی ای استوار هستند؟ و علمای اهل سنت چه صفات و شرایطی را برای حاکم و زمامدار اسلامی ضروری می دانند و آیا می توان ازآن صفات و شرایط، ولایت فقیه یعنی ضرورت فقیه و مجتهد بودن حاکم و زمامدار اسلامی را استنباط کرد؟ و … از جمله سؤالاتی است که این نوشتار درپی بررسی آن‌ها از منظر فقه سیاسی است. https://jcrir.ut.ac.ir/article_78972_fdec0b5694091df3f51294643f4b8538.pdf
